What is Possession for sale?
Possession for sale is a type of drug crime that refers to the possession of an illegal narcotic with the intention of selling the narcotic to a third party. Narcotics include, but are not limited to: marijuana, heroin, cocaine, methamphetamines, and unauthorized prescription medications. Typically, people who possess large amounts of a drug are charged with “possession for sale”, which is a serious criminal offense. In most cases, possession for sale is classified as a felony, which means that people who are convicted of this crime may have to spend over a year in prison.
Possession with Intent to Sell
When law enforcement suspects that a person has committed the crime of possession with intent to sell, they do not have to prove that the person sold any drugs. Rather, they must prove that the person “intended” to sell the drugs he/she had in his/her possession. Therefore, if a person has large amounts of a drug in his/her possession or large amounts of cash in his/her possession, law enforcement can conclude that the person intended to sell narcotics. Law enforcement can then charge the person with possession with intent to sell.
Drug Possession for Sale Criminal Charges
After a person has been arrested for possession for sale, his/her criminal charges will depend upon: the amount of drug in his/her possession, the type of drug in his/her possession, his/her criminal history, and if he/she has prior drug crime convictions. Any of these factors can lead to the enhancement of the person’s charges and legal penalties if the person is convicted.
